Segundo a defesa, o ministro teria se manifestado publicamente sobre a condena\u00e7\u00e3o e n\u00e3o poderia continuar no comando do caso.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Antes da decis\u00e3o do plen\u00e1rio, o mesmo pedido tamb\u00e9m foi rejeitado pela presidente do STM, ministra Maria Elisabeth Rocha.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">No dia 3 de fevereiro, o Minist\u00e9rio P\u00fablico Militar (MPM) protocolou no STM a\u00e7\u00f5es para decreta\u00e7\u00e3o da perda do oficialato de Jair Bolsonaro.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">De acordo com a Constitui\u00e7\u00e3o, o oficial das For\u00e7as Armadas pode ser expulso no caso de condena\u00e7\u00e3o criminal superior a 2 anos de pris\u00e3o por condena\u00e7\u00e3o criminal.
