Situa\u00e7\u00f5es em que o juiz determinar\u00e1 o compartilhamento da cust\u00f3dia e das despesas do animal de forma equilibrada entre as partes.<\/strong><\/p>\n\n\n\n<p>Para isso, o&nbsp;animal deve ser &#8220;de propriedade comum&#8221;, ou seja, ter passado&nbsp;a maior parte de sua vida de forma conjunta, com o casal.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Manuten\u00e7\u00e3o<\/h2>\n\n\n\n<p><strong>Os gastos com alimenta\u00e7\u00e3o e higiene ser\u00e3o&nbsp;de responsabilidade de quem tiver o animal em sua companhia.&nbsp;<\/strong><\/p>\n\n\n\n<p>As demais despesas, como consultas veterin\u00e1rias, interna\u00e7\u00f5es e medicamentos, ser\u00e3o divididas igualmente entre as partes.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Indeniza\u00e7\u00e3o<\/h2>\n\n\n\n<p>A parte que renunciar ao compartilhamento da cust\u00f3dia perder\u00e1 a posse e a propriedade do animal de estima\u00e7\u00e3o em favor da outra, sem direito a indeniza\u00e7\u00e3o.<\/p>\n\n\n\n<p>N\u00e3o cabe repara\u00e7\u00e3o econ\u00f4mica tamb\u00e9m em casos de perda definitiva da cust\u00f3dia causada por descumprimento imotivado do acordo.<\/p>\n\n\n\n<p><strong>Em caso de decis\u00e3o judicial, n\u00e3o ser\u00e1 deferida a cust\u00f3dia compartilhada do animal&nbsp;se o juiz identificar:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>hist\u00f3rico ou risco de viol\u00eancia dom\u00e9stica e familiar;<\/li>\n\n\n\n<li>ocorr\u00eancia de maus-tratos contra o animal.<\/li>\n<\/ul>\n\n\n\n<p>Nessas situa\u00e7\u00f5es, o agressor perder\u00e1 a posse e a propriedade do animal&nbsp;para a outra parte,&nbsp;sem direito a indeniza\u00e7\u00e3o.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Quando n\u00e3o houver acordo, juiz decidir\u00e1 futuro do animal Ag\u00eancia BrasilDecidir o futuro do&nbsp;animal de estima\u00e7\u00e3o&nbsp;quando o casamento ou a uni\u00e3o chega ao fim \u00e9&nbsp;um momento de ang\u00fastia.
