{"id":7338,"date":"2026-05-25T15:00:00","date_gmt":"2026-05-25T19:00:00","guid":{"rendered":"https:\/\/progresso.com.br\/?p=7338"},"modified":"2026-05-25T14:48:43","modified_gmt":"2026-05-25T18:48:43","slug":"alcolumbre-e-fachin-discutem-limites-para-penduricalhos","status":"publish","type":"post","link":"https:\/\/progresso.com.br\/index.php\/2026\/05\/25\/alcolumbre-e-fachin-discutem-limites-para-penduricalhos\/","title":{"rendered":"Alcolumbre e Fachin discutem limites para \u201cpenduricalhos\u201d"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong><em>Projeto sobre remunera\u00e7\u00e3o de ju\u00edzes pode entrar na pauta do Congresso<\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Lucas Pordeus Le\u00f3n &#8211; Ag\u00eancia Brasil<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Os sal\u00e1rios de ju\u00edzes, promotores e procuradores brasileiros com os chamados penduricalhos foi tema de encontro entre os presidentes do Senado, Davi Alcolumbre, e do Supremo Tribunal Federal (STF), Edson Fachin, nesta segunda-feira (25).<img decoding=\"async\" src=\"https:\/\/agenciabrasil.ebc.com.br\/ebc.png?id=1690740&amp;o=node\"><img decoding=\"async\" src=\"https:\/\/agenciabrasil.ebc.com.br\/ebc.gif?id=1690740&amp;o=node\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Os penduricalhos s\u00e3o valores extras somados ao sal\u00e1rio de algumas carreiras que costumam elevar os rendimentos acima do teto constitucional do funcionalismo p\u00fablico.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Os chefes dos poderes Legislativo e Judici\u00e1rio discutiram o futuro anteprojeto de lei sobre a remunera\u00e7\u00e3o da magistratura que pode entrar na pauta do Parlamento.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Em nota conjunta encaminhada \u00e0&nbsp;imprensa, Alcolumbre e Fachin informaram que o debate abordou a necessidade de aperfei\u00e7oamento do sistema remunerat\u00f3rio no servi\u00e7o p\u00fablico.<\/strong><\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cDiante da multiplica\u00e7\u00e3o de vantagens pecuni\u00e1rias acess\u00f3rias \u2014 como gratifica\u00e7\u00f5es, adicionais, abonos e parcelas aut\u00f4nomas \u2014 que comprometem a transpar\u00eancia, tensionam a observ\u00e2ncia do&nbsp;<a href=\"https:\/\/www.jusbrasil.com.br\/artigos\/teto-remuneratorio-dos-servidores-art-37-xi-da-cf\/196643011\" target=\"_blank\" rel=\"noreferrer noopener\">teto constitucional previsto no art. 37, XI, da Constitui\u00e7\u00e3o<\/a>&nbsp;Federal e estimulam litigiosidade funcional\u201d, disseram Alcolumbre e Fachin.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>O artigo 37 da Constitui\u00e7\u00e3o determina que o teto salarial na administra\u00e7\u00e3o p\u00fablica direta \u00e9 de R$ 46,3 mil, igual aos sal\u00e1rios dos ministros do STF.<\/strong>&nbsp;Por\u00e9m, t\u00eam proliferado benef\u00edcios de car\u00e1ter indenizat\u00f3rio que elevam o vencimento dos magistrados e procuradores para acima desse teto. &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Alcolumbre informou que, na reuni\u00e3o com Fachin, foi destacada a jurisprud\u00eancia consolidada do STF que considera inconstitucional vantagens que extrapolem o teto ou que sejam criados benef\u00edcios salariais sem v\u00ednculo com atividade laboral espec\u00edfica.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cReconheceu-se que se trata de quest\u00e3o estrutural, a demandar solu\u00e7\u00e3o legislativa de car\u00e1ter geral que preserve a valoriza\u00e7\u00e3o das carreiras p\u00fablicas\u201d, comunicou em nota conjunta<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Alcolumbre e Fachin acrescentaram que os \u201cdi\u00e1logos institucionais\u201d devem continuar, com envolvimento do Poder Executivo e a outros atores interessados, \u201cvisando \u00e0 constru\u00e7\u00e3o de propostas e ao recebimento de sugest\u00f5es sobre o tema\u201d.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Entenda<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Os&nbsp;<a href=\"http:\/\/%20https\/\/agenciabrasil.ebc.com.br\/economia\/noticia\/2025-07\/supersalarios-no-judiciario-crescem-493-em-2024-mostra-estudo\" target=\"_blank\" rel=\"noreferrer noopener\">gastos do Judici\u00e1rio com sal\u00e1rios<\/a>&nbsp;acima do limite constitucional aumentaram 49,3% entre 2023 e 2024. O valor extra-teto saltou de R$ 7 bilh\u00f5es para R$ 10,5 bilh\u00f5es em apenas um ano, segundo estudo do Movimento Pessoas \u00e0 Frente.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Em meio \u00e0&nbsp;repercuss\u00e3o negativa sobre os supersal\u00e1rios, o Supremo Tribunal Federal (STF) limitou, em julgamento de mar\u00e7o deste ano, os&nbsp;<a href=\"https:\/\/agenciabrasil.ebc.com.br\/justica\/noticia\/2026-03\/decisao-do-stf-permite-penduricalhos-de-ate-70-acima-do-teto\" target=\"_blank\" rel=\"noreferrer noopener\">penduricalhos<\/a>&nbsp;de ju\u00edzes, promotores e procuradores a at\u00e9 35% do valor do teto constitucional.
